Shop and Establishment Act Registration

For the interest and to regulate the working condition of the employees engaged in Shops, Commercial Establishments, Hotel, Theatres and other Establishments, the Bombay Shops and Establishment Act, 1948 come into the force on 11th January 1948.

This Act restricts timing of opening and closing hours of Shops and Commercial Establishment. It keeps control on daily and weekly hours of work of the employees, interval for rest, Spread over. It provide overtime wages, paid holiday and Leave with wages to employees. It also provides Health and Safety. It prohibits employment of Young persons and woman during certain period of Child Labour, Employees working in Shop, Commercial Establishment of Child Labour, Employees working in Shops, Commercial Establishment and Industrial Establishment get the benefits of payment of Wages Act, Workman Compensation Act, Industrial Employment (Standing Orders) Act and Maternity Benefit Act for Woman employees under the provision of this Act. Government may grant exemption under this Act to particular Shop or the Commercial Establishment or class of Shop or Commercial Establishment or class of Shops or class of Commercial Establishment Applied for it.

In order to ensure Ease of doing Business the Government of Maharashtra has simplified the process of issuing the registration of the shops and establishments under the Maharashtra Shops and Establishments Act, 1948.

Accordingly the Labour Department of Government of Maharashtra has issued Notification Dtd. 18.05.2015 regarding issuance of the Registration Certifcate and Renewal of Registration under the Maharashtra Shops and Establishments Act, 1948 within Seven working days from the date of receipt of the application. Failing of which the Registration or Renewal of the Registration of the establishment shall be deemed to have been granted.

Within 30 days from the date of commencement of establishment, in prescribed form along with prescribed fees. Any citizen who wishes to open new shop or a commercial establishment wants to commence its business within the jurisdiction of Government of Maharashtra, has to register itself under The Bombay Shops and Commercial Establishment Act, 1948.

Cancellation Application for Shop & Establishment

The employer shall, within ten days on his closing the establishment, notify to the Inspector in writing. The Inspector shall, on receiving the information and being satisfied about its correctness, remove such establishment from the register of establishments and cancel the registration certificate.

Every Indian state has enacted certain rules and regulations with regard to conditions of work. The objective is to secure uniform benefits for employees working in different establishments, from shops, commercial establishments and residential hotels to restaurants, theatres and other places of public amusement or entertainment.

Every shop and establishment needs to register itself compulsorily under this Act within 30 days of commencement of work. As this is such a basic license, many other licenses require this as proof of a commercial business. For example, most banks will require you to furnish it if you want to open a current account.

Under the Shop and Establishment Act, every business has to seek approval from Department of Labour and keep up-to-date registers regarding details of employment, fines, deductions and advances, salary and holidays. The requirements may vary from state to state. Files related to annual holidays and number of employees need to be submitted to the office of the Municipal Corporation annually.

The shop & establishment act is applicable to every office and shop where commercial activities are carried on even on employing one employee. Your Office /Corporate office will be covered under the Shop & Establishment Act. and the provision of leave and other rules shall be applicable, even when your company is registered under companies Act.

This Act sets rules for working hours per day and week, guidelines for spread-over, rest interval, opening and closing hours, closed days, national and religious holidays, overtime work, rules for employment of children, young persons, and women, rules for annual leave, maternity leave, sickness and casual leave, rules for employment and termination of service, maintenance of registers and records and display of notices and obligations of employers as well as employees.
